Terms of Service

You must be at least 18 years old or the age of majority where you live and legally capable of entering a contract. You agree to provide accurate information, use our products and Site lawfully, comply with applicable export laws, and not transmit malicious code.

We may refuse service, suspend access or cancel an order for legitimate reasons such as suspected fraud, payment failure, inventory errors, unlawful activity or breach of these Terms. You may not reproduce, sell, resell or exploit the Site or its services without written permission.

We work to keep descriptions, prices, promotions and availability accurate but occasional errors may occur. We may correct errors or cancel an affected order and issue a full refund. General Site content should not be your sole basis for decisions where more complete or current information is required.

Prices are shown in U.S. dollars unless stated otherwise and may change without notice. We may modify products, limit quantities or discontinue items. Product images are illustrative; colors, textures, dimensions and packaging of seasonal decorations may vary slightly because of screens, lighting, photography or manufacturing tolerances.

Use decorations in accordance with product instructions, warnings and applicable safety requirements. Products intended for decoration are not toys unless expressly identified as such.

By ordering, you authorize the selected payment method for the displayed total and agree to provide current billing, shipping and contact information. Applicable taxes and charges appear during checkout. Payment options available to you are those displayed at checkout and are processed by secure third-party providers.

An order confirmation is not guaranteed acceptance. We may reject or cancel an order for payment, fraud, inventory, pricing or legal reasons; any captured amount for a canceled order will be refunded.

Our Shipping Policy and Refund Policy are incorporated into these Terms. Delivery estimates are not guarantees, and rights that cannot legally be waived remain unaffected.

The Hapchic name, logo, product presentation, photographs, graphics, text, videos, designs and software are owned by Nova Commerce LLC or its licensors and protected by applicable intellectual-property laws. No license is granted except the limited right to use the Site personally. Written permission is required to reproduce, modify, distribute or create derivative works.

The Site may use or link to Shopify, payment providers, carriers, social platforms and other third parties. Their services and policies are controlled by them. To the extent permitted by law, Hapchic is not responsible for third-party sites or independent services.

When you submit a review, photo, comment or suggestion, you grant Nova Commerce LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, adapt, publish and display that content for store operations and marketing, subject to applicable privacy law.

You confirm you own or have permission to submit it and that it is not unlawful, deceptive, defamatory, infringing, malicious or harmful. We may moderate or remove content but are not obligated to monitor every submission.

Our handling of personal information is described in the Privacy Policy, which is incorporated by reference.

We send transactional communications necessary for orders and accounts. Marketing messages are sent where permitted and with consent where required. Unsubscribe through the message link or email support@hapchic.com. Transactional messages for active orders may still be sent.

You may not use the Site to break laws; infringe rights; harass or harm others; submit deceptive information; transmit malware; spam, phish, scrape or interfere with security; collect others’ personal data without authorization; evade purchase limits; or resell products without written authorization. We may terminate access for violations.

To the extent permitted by law, you agree to indemnify Nova Commerce LLC and its affiliates against third-party claims and reasonable costs arising from your unlawful misuse of the Site, material breach of these Terms, violation of another person’s rights or unlawful User Content.

We may suspend or terminate access for breach, fraud, security risk or unlawful activity. Provisions that by their nature should survive—including ownership, disclaimers, liability, dispute resolution and indemnification—remain effective.

We are not responsible for delay or nonperformance caused by events beyond reasonable control, including severe weather, disasters, war, civil unrest, government action, labor disruption, epidemics, supply-chain interruptions, utility or network failure, and carrier delays.

If a provision is invalid or unenforceable, it will be limited to the minimum necessary and the remainder continues. Failure to enforce a provision is not a waiver. These Terms together with the Privacy Policy, Shipping Policy and Refund Policy form the agreement governing your use of the Site.

We may update these Terms for operational, legal or regulatory reasons. The date above identifies the current version. Where required, material changes will be announced before taking effect. Continued use after the effective date means acceptance, except where applicable law requires additional consent.
